TERMS AND CONDITIONS OF SERVICE
These Terms and Conditions of Service ("Terms") constitute a legal agreement between you ("the Customer", "you") and Xclusive Detailing ("the Company", "we", "our", "us"). By requesting or receiving any of our services ("Services"), you agree to abide by these Terms.
1. SERVICE AGREEMENT
1.1. We agree to provide mobile detailing services as requested by you.
1.2. You agree to provide accurate and complete information regarding the vehicle(s) to be serviced.
1.3. We reserve the right to refuse service to any vehicle at our discretion.
2. LIABILITY AND DAMAGE
2.1. We shall not be held liable for any pre-existing damage or loss to the vehicle(s) or its contents during or after the provision of services.
2.2. Your acknowledgement and agreement state that our liability is limited to the value of the services rendered. We expressly disclaim any liability for consequential, incidental, indirect, or special damages unless caused by our gross negligence or willful misconduct.
2.3. Any complaints or claims must be lodged in writing within 24 hours of completion of the service. Claims lodged after this period will not be acknowledged.
3. PAYMENT TERMS
3.1. You agree to pay the agreed-upon amount for the services rendered by us.
3.2. Payment shall be made in full at the completion of the service, unless otherwise agreed upon in writing.
3.3. We reserve the right to refuse service if payment is not made in full or as agreed. Unpaid invoices may result in a late fee and legal proceedings.
4. CANCELLATION AND RESCHEDULING
4.1. You may cancel or reschedule a service by providing at least 48 hours' notice prior to the scheduled appointment.
4.2. Cancellations made within 48 hours of the scheduled appointment will be subject to a cancellation fee of 25% of the total service cost.
4.3. The cancellation fee will be deducted from any pre-paid amount or charged separately to the customer.
5. INDEMNIFICATION
5.1. You agree to indemnify and hold the Company harmless from any claims, damages, losses, or expenses arising out of the provision of services, except for damages caused by the Company's gross negligence or willful misconduct.
6. APPOINTMENT TIMES AND COMMUNICATION
6.1. We will make reasonable efforts to arrive at the client's designated location within one hour of the scheduled appointment time.
6.2. However, unforeseen circumstances, such as traffic conditions, prior detail services, or other unexpected events, may cause delays beyond our control.
6.3. We will communicate with the Client on the day of the service to provide an estimated time of arrival (ETA) based on the current conditions.
6.4. While we endeavor to maintain punctuality, the ETA provided is an approximation and may be subject to change.
6.5. You agree to provide accurate contact information and to be available at the designated location during the agreed-upon service window.
7. GOVERNING LAW AND JURISDICTION
7.1. These Terms and your use of our services will be governed by the laws of the State of Florida, without regard to its conflict of law principles.
7.2. Any disputes relating to these Terms or our services will be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
8. SEVERABILITY
8.1. If any part of these Terms is deemed invalid or unenforceable, that part will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
9. AMENDMENTS
9.1. We reserve the right, at our sole discretion, to modify or replace any part of these Terms at any time. It is your responsibility to check these Terms periodically for changes.
9.2. Any modifications or amendments will be effective upon posting on our website or providing written notice to the customer.
10. ENTIRE AGREEMENT
10.1. These Terms constitute the entire agreement between you and us, superseding any prior or contemporaneous negotiations, discussions, or agreements.
By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our Services.
